DAVETH · TERMS OF USE
Terms of Use.
These terms are the agreement between you and Daveth for using the website, your account and any plan you buy. They are written to be read. Please read them before you create an account.
1. Who we are
Daveth (“Daveth”, “we”, “us”) is an online platform for learning technology, such as networking, Linux, cloud, automation, AI, Kubernetes and the tools that modern systems run on. It is operated by DAVETH LLC, a limited liability company registered in Montana, USA, based in Kalispell, MT 59901, USA. You can reach us at support@daveth.com about anything in these terms.
By creating an account, buying a plan or using Daveth, you agree to these terms and to our Privacy Notice and Refund and Cancellation Policy, which form part of them. If you do not agree, please do not use Daveth.
2. Who can use Daveth
You must be at least 18 years old to create an account or buy a plan. An account is for one person. You may not share it, sell it or let anyone else use it.
3. Your account and signing in
- You sign in with a six-digit code we email to you. There is no password. Keep your email account secure, because anyone who can read your email can sign in as you.
- An account can be signed in on one device at a time. Signing in on a new device signs out the previous one. A sign-in lasts up to seven days.
- Give us a real name and an email address you control, and keep them up to date. Tell us at once at support@daveth.com if you think someone else has used your account.
4. What Daveth provides
Daveth provides lessons, videos, labs and practice material, organised into courses. Each plan opens the courses shown for it on the pricing page: Daveth Pro (Network) opens the network courses, Daveth Pro (AI Engineering) opens the AI courses, and Daveth Elite opens every course on Daveth. Courses added later are included at no extra cost while the plan is active: in Daveth Elite, every course added; in a Daveth Pro plan, the courses added to its subject. We keep improving the courses, so lessons and labs may be added, corrected, reorganised or retired over time.
Daveth is learning material. It does not promise any particular outcome, such as a job or a qualification, and fees that other organisations charge are not part of any plan.
5. Plans, prices and renewal
- Plans are subscriptions, billed monthly or yearly in US dollars at the price shown when you buy. Where tax applies, it is shown at checkout.
- Your plan renews automatically at the end of each billing period, at the then-current price, until you cancel. If we change the price of your plan, we will tell you by email before it applies to your next renewal.
- You can cancel at any time from your account page. Your plan then runs to the end of the period you have already paid for, and does not renew.
- Moving up or across to a plan that costs more takes effect at once; you pay the difference for the rest of the current period. Moving down to a plan that costs less takes effect at the end of the current period: until then you keep the plan you have, and nothing is charged or credited.
- A yearly plan can be moved to monthly billing when the year ends. Write to us before the renewal date.
- An introductory offer, such as a founding price, applies on the terms shown with it when you buy, and lasts only as long as that subscription continues. A subscription started again later is at the price shown then.
6. Payment
You buy from DAVETH LLC. Payments are processed by Stripe, which takes the card payment for us. We issue the invoice, and sales tax is added at checkout where it applies to you. Stripe handles your card details under its own privacy policy; Daveth never sees or stores your card number.
- If a renewal payment fails, your access ends 12 hours after the first failed attempt. The payment is tried again; if a later attempt succeeds, your access returns. If every attempt fails, the plan is cancelled.
- If a payment is disputed with your bank or card issuer (a chargeback), access to the plan is closed while the dispute is open. If the dispute is decided in our favour, write to us and we will reopen it.
7. Refunds
Payments are not refunded, except where the law requires it. The details, including how to ask, are in the Refund and Cancellation Policy. Nothing in these terms takes away a right to cancel or to a refund that a consumer law applying to you gives you.
8. What you may do with the material
While your plan is active, we give you a personal, non-exclusive, non-transferable right to use the material in your plan for your own study. You may not:
- share your account, or give anyone else access to lessons, videos or labs;
- download, record, copy, scrape, resell, publish or redistribute any part of Daveth, including videos, lab files and practice questions, except for notes you make for your own study;
- use automated tools to access Daveth, or try to get around its access controls, request limits or security;
- use Daveth to break the law or to harm Daveth, its learners or anyone else.
The material on Daveth is protected by copyright and belongs to Daveth or its licensors. These terms do not give you any ownership of it.
9. Daveth certificates
Where Daveth offers a certificate of completion, it is issued by Daveth and records what you completed on Daveth; it is not a qualification awarded by any other organisation. It is earned under the rules shown before you start, is valid for the period stated on it, and may be withdrawn if it was obtained by cheating, by someone else’s work or through a mistake on our part.
10. Trademarks
Daveth is independent and is not affiliated with, endorsed by or sponsored by the makers of the products and technologies it teaches. The names of products, platforms and certifications that appear on Daveth are the trademarks of their owners and are used only to describe what a lesson covers.
11. Suspending or ending an account
We may suspend or close an account that breaks these terms, for example by sharing access, copying material or misusing the service. Where we can, we will tell you why first and give you a chance to respond. If we close an account for a serious breach, a paid plan is not refunded, except where the law requires it.
You can stop using Daveth at any time. You can delete your account from your account page, or by writing to support@daveth.com; deleting an account cancels its plan first. An account with no plan and no sign-in for six months is removed, with its learning record: we email you 30 days before, and signing in keeps it.
12. Availability
We work to keep Daveth available and accurate, but it is provided as it is and as it is available. It may sometimes be unavailable for maintenance or for reasons outside our control, and the material may contain mistakes; please tell us when you find one. The current state of the service is shown on the status page.
13. Responsibility and its limits
To the fullest extent the law allows, Daveth is not responsible for indirect or consequential loss, such as lost income, lost opportunities or lost data, arising from your use of Daveth, and our total responsibility to you for any claim is limited to the amount you paid Daveth in the 12 months before the claim arose.
Nothing in these terms limits responsibility that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence, and nothing affects your rights as a consumer under the mandatory laws of the country where you live.
14. Changes to these terms
We may update these terms, for example when the service or the law changes. We will publish the new version with its effective date and, for a change that matters to you, tell you by email or when you next sign in. If you continue to use Daveth after a change takes effect, the new terms apply. If you do not agree, you can cancel your plan before it renews.
15. Law and disputes
If something goes wrong, please write to support@daveth.com first; we will try to resolve it within 30 days. These terms are governed by the laws of the State of Montana, USA. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring a claim in its courts.
16. General
If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. You may not transfer your rights under these terms to anyone else. We may transfer ours if Daveth is transferred to another operator, who will then be bound by these terms.
